These General Terms and Conditions (GTC) govern the order, use, and conditions of the MuseumsuferCard and the MuseumsuferTicket, issued by the Cultural Office of the City of Frankfurt am Main, Brückenstraße 3–7, 60594 Frankfurt am Main. The MuseumsuferCard is valid for 365 days from the desired date, and the MuseumsuferTicket is valid for two consecutive days as an admission ticket for currently 39 museums (future deviations are possible).

2. Validity and Services

With the MuseumsuferCard, all holders receive free admission to all permanent and special exhibitions at currently 39 museums for 365 days from their desired date. Excluded from admission with the MuseumsuferCard are major special exhibitions with international loans at the Städel Museum – these are listed on the Städel Museum’s website. The price also includes the delivery of the art magazine art kaleidoscope (every 3 months) starting from the next possible issue, as well as free admission to all venues during the “Night of the Museums” and the Museumsuferfest.

With the MuseumsuferTicket, all holders receive free admission to all permanent and special exhibitions at currently 39 museums for two consecutive days. If the day following the start of use is a closing day at a museum, the validity period will be extended by one day.

Guided tours are not included in the services of the MuseumsuferCard and the MuseumsuferTicket. Preferential treatment, e.g., priority admission during high visitor numbers, is not associated with the MuseumsuferCard and the MuseumsuferTicket.

A current overview of all participating venues is available at www.museumsufercard.de, www.museumsuferticket.de, and www.museumsufer.de. Use is exclusively for personal visits to the facilities listed there; the MuseumsuferCard and the MuseumsuferTicket are non-transferable.

3. Use

The MuseumsuferCard and the MuseumsuferTicket must be presented upon request in conjunction with a personal ID card at the museum ticket counters.

4. Conclusion of Contract

The MuseumsuferCard and the MuseumsuferTicket are available at all ticket counters of the 39 museums, at the listed advance booking offices, and online via the internet. Generally, the MuseumsuferCard is limited to a term of 1 year. If explicitly ordered by checking the box on the application form, the MuseumsuferCard can also be obtained as a subscription until revoked. Before the current card expires, the follow-up card for the next year will be automatically sent. The subscription can be canceled at any time, but no later than 4 weeks before the current card expires. The MuseumsuferTicket is valid for two consecutive calendar days from the selected purchase date.

5. Changes to Information, Loss, Damage

Changes to names, addresses, etc., must be reported in a timely manner. The loss or damage of the MuseumsuferCard must also be reported immediately. The MuseumsuferCard will be blocked, and upon request, holders will receive a replacement card. The processing fee for this is currently 15 Euros. The loss of the MuseumsuferTicket will not be reimbursed.

6. Data Protection – Information according to Article 13 GDPR

The contract is concluded with the Museum Cooperation Pool, represented by the City of Frankfurt am Main. The contracting party uses k/c/e Marketing³ GmbH for the processing of the contract.

The Cultural Office Frankfurt am Main, Dept. 41.10, museumsufer.frankfurt@stadt-frankfurt.de is responsible for data processing.

The data is collected for the purpose of commercial and practical processing. In addition, the participating institutions (museums) may use the data for sending informational material. The disclosure of data to third parties is only permitted for the fulfillment of contractual obligations (e.g., payment processing and shipping) and within the framework of legal obligations. The data will be stored until the termination of the contractual relationship and the fulfillment of the associated obligations, provided that no legal retention periods prevent this. Data subjects can request information about their stored personal data at any time. If this data is incorrect, there is a right to rectification. A complete deletion can only take place after the fulfillment of contractual obligations and after the expiry of legal retention periods. Data subjects can object to data storage at any time by notifying the contact persons mentioned above. The right to object only applies to data that the contracting party is not obliged to store and process. There is a right to lodge a complaint with the following supervisory authority: The Hessian Commissioner for Data Protection and Freedom of Information, Gustav-Stresemann-Ring 1, 65189 Wiesbaden, +49(0)611 140 80, poststelle@datenschutz-hessen.de

SUMMARY Data Protection Policy

The processing of personal data is carried out in compliance with the General Data Protection Regulation (GDPR) and the Hessian Data Protection and Freedom of Information Act (HDSIG). A detailed data protection declaration can be viewed at www.museumsufercard.de/datenschutz.

7. Subscription to our Newsletter

On our website, users are given the opportunity to subscribe to one or more newsletters. The kulturkurier.de system by data kulturlink ag (Berlin) is used as the newsletter system. For legally compliant and data protection-friendly design, the so-called double opt-in procedure is used. In this process, the potential recipient first receives an email with a confirmation link. Only after successful confirmation is the address added to the distribution list. You can revoke your consent to the storage of your data and the use of your address for sending by using the “unsubscribe link” at the end of each newsletter. Further information can be found here: https://kulturkurier.info/kulturnewsletter/

Which personal data is transmitted to the data controller when ordering the newsletter can be seen from the input mask used for this purpose. When registering for the newsletter, we also store the IP address assigned by the Internet Service Provider (ISP) of the computer system used by the data subject at the time of registration, as well as the date and time of registration.

The collection of this data is necessary to be able to trace the (possible) misuse of a data subject’s email address at a later date and thus serves the legal protection of the data controller. The personal data collected during newsletter registration is used exclusively for sending our newsletter. Furthermore, newsletter subscribers may be informed by email if this is necessary for the operation of the newsletter service or a related registration, as might be the case with changes to the newsletter offering or changes in technical conditions. No personal data collected within the scope of the newsletter service will be passed on to third parties. For tracking open and click rates, we use so-called tracking codes in the newsletter to record the opening of newsletters and the accessing of web links.

The collection is carried out with pseudonymized storage, by replacing all personal data (e.g., the email address) with an identification number (pseudonym). This means we do not store personal data together with usage data such as the opening of newsletters or the accessing of web links. Furthermore, it is ensured that these data cannot be merged later. If you, as a recipient, wish to object to this pseudonymized tracking, you can unsubscribe from the list via the opt-out link at the end of each newsletter.

8. MuseumsuferCard and MuseumsuferTicket with QR Code

The abbreviation “QR” stands for “quick response.” It is a two-dimensional, electronically readable code composed of dots arranged in a square. The QR code on the MuseumsuferCard and the MuseumsuferTicket contains the purchased card type (single, reduced, or family), the validity date, the card number, and the corresponding verification code. The collected data is transmitted to the processing partner k/c/e Marketing³ GmbH (Ludwigstraße 33-37, 60327 Frankfurt am Main). In addition to the processing partner, only the Cultural Office of the City of Frankfurt am Main and the participating museums have access to the aggregated data. There is no automatic assignment of stored usage data to your customer data. No personalized usage profiles are created. Furthermore, no data is passed on to third parties.

09. Disclaimer of Liability

The City of Frankfurt am Main is liable only for damages resulting from an intentional or grossly negligent breach of duty, insofar as these are financial losses. Liability for damages arising from the use of the MuseumsuferCard and the MuseumsuferTicket in the partner institutions is excluded.

10. Final Provisions

Should individual clauses of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
German law applies. The place of jurisdiction is Frankfurt am Main.
